GENERAL SAFETY INFORMATION:
Yes! We are WILD!
When you sign up for a class at WildCraft, you are agreeing to participate in an active and exciting experience. We will find any excuse to take our classes outdoors, for hiking and exploring the nearby fields and forests. If a light hike may present health challenges to you, please let us know in advance! Most of our curriculum depends on this interaction with nature, and we want to make sure you are prepared for the experience.
Even with the best preparation, we must acknowledge that nature is unpredictable! Our teachers will do their best to keep you safe, but we do require that you sign a liability waiver and assumption of risk agreement before participating in any WildCraft workshop. This will be sent to you electronically. Please read below to view our waiver in advance.
WAIVER, RELEASE OF LIABILITY & ASSUMPTION OF RISK AGREEMENT
In consideration of my participation in CLASSES, WORKSHOPS, EXPEDITIONS and/or OUTINGS (collectively referred to as “the Activity”) hosted by WILDCRAFT STUDIO SCHOOL LLC (“Wildcraft”), I, for myself and on behalf of my heirs, assigns, and legal representatives, knowingly and voluntarily enter into this Waiver, Release of Liability & Assumption of Risk Agreement (the “Waiver”) and waive any and all rights, claims, damages, injuries, costs, expenses, liabilities, demands, or causes of action of any kind (collectively, “Claims”) arising out of my participation in the Activity, and release and forever discharge WildCraft, and its affiliates, managers, members, agents, teachers, staff, volunteers, legal representatives, successors and assigns, from any and all Claims for any type of physical or psychological injury to me, any illness, any property damage, or any other physical, economic or emotional loss that I may suffer as a result of my participation in the Activity, including during travel to and from the Activity or a Wildcraft event related to the Activity.
I understand and agree that my release of liability extends to all wrongful acts of the released parties, including the negligence of same, to the extent allowed under Oregon law.
I agree that WildCraft, and its members, managers, employees, and agents, are not responsible for any errors, omissions, negligent acts or failure to act on behalf of any party or entity conducting the Activity or a specific event or activity on behalf of WildCraft.
I agree to indemnify, defend, and promptly reimburse WildCraft, and its members, managers, employees, and agents, for any and all claims, suits, damages, demands, costs (including reasonable attorney’s fees), expenses, liabilities, injuries, illnesses, or causes of actions of any kind related to my actions, omissions, or participation in the Activity.
I acknowledge that I am voluntarily participating in the Activity and am participating in the Activity entirely at my own risk. I am aware of and accept all risks associated with participation in the Activity, including traveling to and from the Activity. I understand that the risk of injury or illness may exist from my own or from other’s negligence, or from conditions related to travel, viruses or pandemics, air quality, or the location of the Activity. Nonetheless, I assume all risks, both known and unknown to me, in my participation in the Activity, including travel to and from this Activity.
I acknowledge that the Activity itself may involve a test of my physical and mental limits, and depending on the Activity, may carry with it certain risks and hazards, including the potential for death, serious injury, illness, or property loss. The risks may include, but are not limited to, those caused by terrain, facilities, natural disaster, wildfire, temperature, weather, lack of hydration, animals, snakes, scorpions, condition of participants, equipment, vehicular malfunction, or the actions of others. I agree to conduct myself in a safe and prudent manner at all times during the Activity.
I acknowledge that I have carefully reviewed this Waiver and I fully understand that it is a release of liability.
I consent to and permit emergency medical treatment in the event of my injury or illness while participating in the Activity. In the event that I should require medical care or treatment, I agree to be financially responsible for any costs incurred as a result of such treatment. I am aware and understand that I should carry my own health insurance.
In the event that any damage to equipment or facilities occurs as a result of my or my family’s willful actions, neglect or recklessness, I acknowledge and agree to be held liable for any and all costs associated with the repair or replacement of such equipment or facilities due to our actions.
This Waiver is governed by the laws of the State of Oregon. In the event that any provision or portion of this Waiver is deemed to be unlawful, unenforceable or invalid, the remainder of this Waiver shall remain in full force and effect.
I affirm that I am age 18 years or older, that I have read this Waiver and fully understand and agree to its terms. I understand by signing this Waiver I am giving up substantial rights and I do so freely and voluntarily, without any inducement, assurances, or representations, advice, or input about the interpretation or effect of this Waiver. I intend for my signature to constitute a complete and unconditional release of liability to the greatest extent allowed under Oregon law.
